On May 27th, 2021, the US Department of State expanded its criteria to approve National Interest Exception (“NIE”) waivers to now also include those traveling to provide vital support or executive direction for significant economic activity in the United States. This is an expansion from the very limited ground of demonstrating that the foreign national must be providing vital support or executive direction to a critical infrastructure sector. The expectation is that executives and managers of major U.S. commercial enterprises will now once again qualify for National Interest Exception waivers to come directly to the US from Brazil, South Africa, the Schengen Area, United Kingdom and Ireland. (The Department of State also continues to grant NIEs for qualified travelers seeking to enter the US for purposes related to humanitarian travel, public health response, and national security.)
